The Cosmixias name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cosmixias or its affiliates. You may not use such marks without the prior written permission of Cosmixias.
User Content
By submitting content to our platform, you grant Cosmixias a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute such content in any media.
Limitation of Liability
To the maximum extent permitted by law, Cosmixias shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, our services.

In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Cosmixias in the last six months, or $100 if you have not made any payments to Cosmixias.

Informal Resolution

Arbitration
If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association.

Class Action Waiver
You agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis, and that you will not seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action.
Termination Policies
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to:
Violation of these Terms of Service.
Engaging in fraudulent or illegal activities.
Failure to pay for services after multiple reminders.
At our sole discretion for any reason we deem necessary.
Upon termination, your right to use our services will immediately cease. If you wish to terminate your account, you may simply discontinue using our services or contact us to request account deletion.
Refund Policy Upon Termination
If your account is terminated:
- For violation of our Terms: No refund will be provided for any remaining subscription period.
- By your own request: Refunds may be provided on a prorated basis for unused subscription periods, subject to our refund policy.
- Due to service discontinuation: Full refunds will be provided for any unused subscription periods.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
